The bot is pretty safe, if you don't abuse it.
Square Enix mostly relies on reports from other players to check on you, and if they find for example that you are gathering so far for 48 hours straight without resting, then you usually get a temporal ban. If they keep catching you then you get a permanent ban, usually on strike number three.
There isn't a simple recipe as to how to not get caught using the gathering function. The general rule is that you shouldn't abuse the bot. For example if you leave it for more than 24 hours straight without logging out, you are asking for a ban.
I have used both the gathering list and the forager add-on and both are great. But be wise as to how to use them.
